It is a common misconception that the court, when considering any financial and/or children arrangements on divorce, will look at who started the divorce proceedings and what fact is relied upon in the petition. In fact, the court does not consider this at all as the financial and children arrangements will be considered entirely separately to the divorce. If allegations made in the divorce are relevant to the financial or children arrangements then they can be repeated when dealing with those arrangements but the other party will be permitted to dispute the allegations even though he/she did not contest the divorce itself.
