The way in which the law currently stands in the UK is that a child is not recognised as a person until it has been born alive. Therefore, unfortunate as this may be, there is generally no claim that can be made for a still born baby or miscarriage.

If a baby is born and dies very shortly afterwards (a neo-natal claim) and negligent care can be established as the cause then the law does allow for a bereavement claim. It may also be that the parent(s) can claim additionally for the psychiatric / psychological damage sustained.
