Our employment law team, specialist solicitors in their field and with offices in Colchester and Clacton, report that rights for disabled workers have undergone momentous changes in the last decade.
Richard Porter, Employment Law specialist advising in Colchester and Clacton, says:
“Both employers and employees alike should be aware of the legal obligations on all employers to provide opportunities and support for disabled workers”.
Disabled workers share the same general employment rights as other workers, but there are also some special provisions given to disabled employees under the Disability Discrimination Act 1995 (DDA).
Under the DDA, it is unlawful for employers to discriminate against disabled people for a reason related to their disability
They have a duty to make 'reasonable adjustments' to ensure that the workplace and employment practices do not put the disabled employee at a substantial disadvantage.
For example adjustments may need to be made to the buildings where the disabled person works and flexibility may need to be introduced into core working hours so that the disabled person is able to attend treatment or rehabilitation.
